Terms of Service
Last updated October 13, 2026
These terms govern your use of gosummer.ai and the Summer service, offered by Compound Technologies, Inc., doing business as Summer (“Summer,” “we,” “us”). By using the website or the service, you agree to these terms. Our Privacy Policy explains how we handle personal information.
If your organization has signed a separate agreement with us for the Summer service, that agreement controls where it conflicts with these terms.
Who can use Summer
Summer is for businesses. You must be at least 18 and able to form a binding contract. If you use Summer for an organization, you confirm that you can accept these terms for it, and “you” includes that organization.
Accounts and sign-in
Summer workspaces are available by invitation. You cannot create an account through the website. Your organization’s administrator, or Summer, decides who has access. Keep your sign-in method secure. Tell us at support@gosummer.ai if you think someone used your account without permission. We may suspend access to protect the service or other users.
Demo requests
When you request a demo, you agree that we may contact you about Summer. Do not include patient information in a demo request.
Customer data
Your organization keeps its rights in the data it gives us through the service (“customer data”). We use customer data to provide, secure and support the service for your organization, as our agreement with your organization describes. Where HIPAA requires a business associate agreement, your organization and Summer must sign one before any protected health information is processed.
No medical advice
Summer helps support teams handle requests such as order status, pharmacy follow-ups, intake and billing. It does not give medical advice or make clinical decisions. Treatment questions belong with licensed clinicians. Your organization is responsible for its care, its clinical decisions, the messages it sends to patients and its compliance with the laws that apply to it. This includes reviewing each outbound action before it approves it in Summer.
Acceptable use
You agree that you will not:
- break the law or help someone else do so;
- send spam or misleading messages through the service;
- submit information you do not have the right to share;
- try to access accounts, systems or data without permission, or probe, scan or test the security of the service;
- interfere with or overload the service, or get around its limits;
- copy, scrape, reverse engineer or resell the service, except where the law allows it despite this limit;
- upload malware or other harmful code.
Our property
Summer, its software, design, text and trademarks belong to us or our licensors. These terms give you a limited, revocable right to use the website and, if you have access, the service for your organization’s internal business purposes. If you send us feedback, we may use it without any obligation to you.
Third-party services
Some features rely on other companies, such as Google for sign-in. Their terms and privacy policies apply to your use of their services, and we are not responsible for them.
Changes and ending access
We may change or stop parts of the website or service. You may stop using Summer at any time. We may suspend or end your access if you break these terms or if we need to protect the service, other users or the public. Sections that by their nature should continue after access ends will continue.
Disclaimers
THE WEBSITE AND SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
We do not promise that the service will be uninterrupted or free of errors, or that AI-drafted replies will always be correct. Review each outbound action before you approve it.
Limitation of liability
TO THE EXTENT THE LAW ALLOWS, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE WEBSITE OR SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR US$100.
Indemnity
If you use Summer for an organization, that organization will defend and indemnify Summer against third-party claims that arise from its customer data, its use of the service in breach of these terms or its violation of the law.
Governing law
California law governs these terms, without regard to its conflict-of-law rules. The state and federal courts in San Francisco County, California, have exclusive jurisdiction, and you and Summer consent to them.
Changes to these terms
We may update these terms. We will post the new version on this page and update the date at the top. If you keep using Summer after a change takes effect, you accept the updated terms.
